I am an American and live in China. I have been approached by a major golf equipment maker and apparel lines also. Their company has a hiring freeze on now(worldwide), even their sales are up from last year in China though below budget. I am a trained sales professional and have built a network of golf contacts. I offered to bring in sales, if they 1.issued me business cards, 2.they paid my exenses(tansportation/telecommunications and occasional golf outing, plus use of their equipment, since i play with a different brand and am a low handicap golfer that can bring in more sales on the golf course) 3.housing alowance 4.Hire me after sales freeze ends. I offered to let them figure a commission based on these conditions
. They however countered with their 'legalese' citing company policy limits them as follows 1.'...can only engage with a company (legal entity)as "service agency" instead of individual person;
2) can not deduct from sales result to pay commission to agency directly, but we can sign a service contract with agency and pay the service fee after the business transaction is completed;
3) apart from the service fee, they will not cover any other cost of this agency, nor will it issue official authorization or business card;
When I obtain sales, I have to insist that they not use my contacts so I think I should submit PO w/o client name, have them submit commissions in advance of submissions(this is not within their stated framework). Their lead times for apparal is 2 months and they will give me samples to show customers. They need me and my network,yet cannot hire me and want to get away with me 'footing the bill' without risk to them. Their lawyers never know what sales entails and create their policy without regard to an individual country's situation compared to the rest of the world. Any experience out there with a similar situation? Is it workable? Should I 'pass' on the opportunity?

Business is business. They are trying to get as much as they can out of you the same way you are with them. Either play or pass. I think you need them more than they need you. Good luck with whatever you decide to do.
